CWA/Celanese Safety Litigation Resolved
The following notice was agreed to by the parties as part of the settlement of CWA's lawsuit over toxic exposure at Celanese facilities in Texas.
CWA has dismissed litigation against Celanese Ltd. that was based on information provided to CWA, which raised concerns over the health and safety of CWA members dispatched to perform telephone work at the Pampa plant in the 1970s and early 1980s. Approximately six years ago, CWA published some of the information that had been provided to it in the CWA News, on its website, and in correspondence to its members, regarding the industrial practices of Celanese Ltd. (then known as Hoechst Celanese Chemical Group).
CWA, its health and safety department, its scientific and medical consultants, and its lawyers have spent nearly six years in intense investigation of Celanese and its practices. CWA's lawyers and its scientific and medical consultants have analyzed hundreds of thousands of documents and have interviewed and deposed some of the world's leading experts in relevant medical and scientific fields. As a result of these efforts, based upon updated information secured through six years of research, investigation, analysis and depositions, CWA has concluded that there is no evidence that the Celanese Pampa plant failed to comply with existing health and safety regulations or otherwise failed to conduct its operations in a responsible manner.
As a result, CWA has dismissed its lawsuit. This conclusion is based upon the information available to CWA at this time, and is not intended to substitute for the advice of any member's doctor or attorney in any specific individual circumstance. CWA's lawsuit was an expression of the union's vigilance in the protection of its members' health and safety, and CWA will remain vigilant to protect the health and safety of its members in their workplace.
