Arbitrator Orders Recognition at AT&T Unit

Finding AT&T guilty of violating the neutrality and consent election agreement, an arbitrator has awarded immediate union recognition for 103 provisioning workers at AT&T Local Network Services in Orlando, and has ordered that recognition for a second unit of 74 maintenance workers be decided on the basis of card check.

CWA may launch a new organizing drive after four months instead of the one year usually required under the agreement, and AT&T must post a notice of the arbitrator's decision throughout the campaign.

Tom Donahue, third party neutral, found that AT&T held a captive audience meeting on July 16, one day before scheduled representation elections. A district manager conducted the meeting and responded to questions posed by supervisors and others in such a way as to discourage workers from voting for the union.

Though both units had previously submitted show of interest cards for at least 50 percent plus one of the workers, after the captive audience meeting the provisioning unit rejected the union 41-53. The maintenance workers followed suit by a vote of 32-39.
