Adelphia Settles NLRB Charges in Morgantown

CWA Local 2004 is scheduled to return to bargaining with Adelphia Cable on Sept. 16, armed with an NLRB settlement agreement local President Ron Gaskins hopes will result in a contract for the 43-member bargaining unit and long-term job security for about a dozen customer service sales representatives whose work the company transferred to another location.

Adelphia agreed to settle unfair labor practice charges filed by CWA, District 2 Vice President Pete Catucci reported, in lieu of the regional National Labor Relations Board issuing a formal complaint. The agreement requires Adelphia to post a notice at its Morgantown, W.Va., location that it will bargain in good faith, that it will return the bargaining unit work of the customer service reps that it transferred to its nonunion Colorado Springs Call Center, and that it will bargain in good faith regarding any future intention to permanently transfer such work.

"Maybe since they've had to deal with the NLRB, they'll come back to the table with a new attitude," Gaskins said. "We would hope they've seen the error of their ways and will be more interested in negotiating a contract for our members."

While the settlement agreement stops short of requiring Adelphia to admit it broke the law, it does require the posting of an additional notice stating that "We will not" transfer bargaining unit work, tell employees the company will transfer work or that they will receive higher wages if they leave the union, pay workers who returned to work during the local's five-week strike higher wages than provided in the union contract or interfere with the employees' right to join a union and choose a collective bargaining representative. In August, the board found Adelphia had engaged in several of these activities.

CWA ran a half-page ad in Morgantown's Dominion Post letting the public know that the NLRB found the company's actions "illegal."

Adelphia was scheduled to respond in U.S. Bankruptcy Court in New York on Sept. 11 to a CWA filing that its "blatant hostility towards labor undermines confidence" in its ability to manage its own reorganization. A hearing on the filing is scheduled for Sept. 16.
