Cable Commission Presses Comcast for Action Plan to Correct Violations: Detroit agency endorses find

Detroit, Michigan – In the wake of an independent report that documented more than 40,000 code violations in Comcast Communications' Detroit cable operations, the city Cable Communications Commission has endorsed the report's findings and set a May 7 deadline for Comcast to show how it will fix these problems.

The commission is seeking an action plan and timetable from Comcast as to how it will correct the problems and code violations identified in "Plant Safety Evaluation of Comcast Cable in the City of Detroit, Michigan," a technical audit conducted in December 2003 by Kramer.Firm, Inc., and commissioned by the Communications Workers of America.

In a letter to the vice president and general manager of Comcast Cablevision of Detroit, the Cable Commission reminded the company that its franchise agreement with the city requires Comcast to comply with applicable laws and regulations and to inspect its system to keep it up to code.

In the letter, the commission noted that the report cites numerous instances of the system's apparent noncompliance with the National Electric Safety Code (NESC) and the National Electric Code (NEC).

Comcast must provide a written response to the commission by May 7, addressing "in detail each violation of the NESC and NEC cited" in the report, along with a "comprehensive corrective action plan" for review and approval, the commission said.

The commission also reminded Comcast that it had not submitted required information about the performance and technical specifications of its cable operation, as required by the company's agreement with the city. The commission directed Comcast to submit this information, as well as proof of performance tests and other required reports, by May 7.

Comcast was warned that there would be no extension of the deadline for turning in this information. The commission pointed out that the report, as well as the lack of test results, "are substantial and documented evidence of breaches of the franchise agreement by Comcast," it stressed.
